Kenibe Marketplace – Terms and Conditions

Welcome to Kenibe Marketplace (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your use of our website, mobile site, and any associated services (collectively, the “Platform”). By accessing or using Kenibe Marketplace, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. About Kenibe Marketplace

Kenibe Marketplace is an online multivendor marketplace that allows third-party sellers (“Vendors”) to list and sell their products directly to buyers (“Customers”). We provide the platform but do not own, create, sell, resell, or control the products listed.

2. Eligibility

  • You must be at least 18 years old to register and use Kenibe Marketplace.
  • You agree to provide accurate, complete, and updated information during registration.
  • Vendors must comply with all applicable local and international laws.

3. User Accounts

You are responsible for maintaining the confidentiality of your account information and password.

  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate our Terms.

4. Vendor Clause

By registering as a Vendor on Kenibe Marketplace, you agree to the following:

  • Product Listing: You are responsible for accurately describing your products, including all necessary details like pricing, stock availability, shipping options, and product specifications.
  • Compliance: All products must comply with applicable local and international laws, including safety standards, intellectual property rights, and regulatory approvals.
  • Order Fulfillment: You must promptly process, package, and ship orders received through Kenibe Marketplace within the agreed timeframe.
  • Customer Service: You are responsible for providing after-sales support to your customers, including handling inquiries, returns, and complaints.
  • Vendor Fees: You agree to pay any commissions, listing fees, or transaction fees as specified in Kenibe Marketplace’s Vendor Payout Policy.
  • Indemnity: You agree to indemnify and hold harmless Kenibe Marketplace from any claims, damages, or liabilities resulting from your products, listings, or actions on the Platform.
  • Prohibited Products: You must not list illegal, counterfeit, hazardous, or prohibited goods on the Platform. Violation may result in account suspension or legal action.

5. Customer Clause

By registering or making a purchase as a Customer on Kenibe Marketplace, you agree to the following:

  • Accurate Information: You must provide correct and complete delivery, payment, and contact information.
  • Due Diligence: You are responsible for reviewing product descriptions and Vendor ratings before making a purchase.
  • Order Acceptance: Once an order is placed, it constitutes a binding contract between you and the Vendor, subject to the Vendor’s return and refund policies.
  • Returns and Refunds: Returns, exchanges, and refunds are subject to the individual Vendor’s policies. Kenibe Marketplace may assist in mediating disputes but is not obligated to guarantee refunds.
  • Prohibited Activities: Customers must not engage in fraudulent activities, such as placing fake orders, abusing refund policies, or misusing the review system.
  • Reviews and Feedback: Customers are encouraged to leave honest reviews but must avoid defamatory, abusive, or false content.

6. Payment Terms

  • Payments for products purchased on Kenibe Marketplace are processed through [insert payment methods, e.g., Paystack, Flutterwave, PayPal].
  • Vendors will receive payouts according to our Vendor Payout Policy.
  • Kenibe Marketplace may charge a commission or service fee on each transaction.

7. Shipping and Delivery

  • Shipping methods, times, and costs are determined by individual Vendors.
  • Kenibe Marketplace is not responsible for shipping delays, lost packages, or issues arising during delivery.

8. Returns, Refunds, and Disputes

  • Return, refund, and exchange policies are set individually by Vendors.
  • Customers should review the Vendor’s policy before making a purchase.
  • Disputes between Customers and Vendors must first be attempted to be resolved between the two parties; Kenibe Marketplace may intervene at its discretion.

9. Prohibited Activities

You agree NOT to:

  • List or sell illegal, counterfeit, or prohibited items.
  • Engage in fraudulent transactions or activities.
  • Infringe on the intellectual property rights of others.
  • Post false, misleading, or defamatory content.

10. Intellectual Property

  • All content on Kenibe Marketplace, including logos, designs, texts, graphics, and software, are the property of Kenibe Marketplace or its licensors.
  • Vendors retain ownership of their product images, trademarks, and branding but grant Kenibe Marketplace a license to use such content for promotional purposes.

11. Limitation of Liability

  • Kenibe Marketplace acts solely as a facilitator between Vendors and Customers.
  • We do not guarantee the quality, safety, legality, or authenticity of products sold on the Platform.
  • We are not liable for any damages, direct or indirect, resulting from the use of or inability to use the Platform.

12. Suspension and Termination

  • We reserve the right to suspend or terminate your account without notice if you violate these Terms or engage in any conduct that harms our Platform or users.

13. Modifications

  • We may update these Terms at any time by posting the updated version on Kenibe Marketplace.
  • Your continued use of the Platform after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Insert Country/State].
